Pediatric Associates

The covered entity (CE), Pediatric Associates, discovered that a binder containing paper logs of patient record releases was missing on January 24, 2015. After a search and investigation, the CE determined that most likely the binder was unintentionally discarded. The types of protected health information (PHI) contained in the logs included patients' names, internal chart numbers, recipients of releases, and explanations for the record release (i.e. “parent requested”). The CE provided breach notification to HHS, affected individuals, and the media. In response to the breach, the CE changed its procedures to require that record releases be logged electronically. The CE archived or shredded all paper record release logs. OCR obtained assurances that the CE implemented the corrective actions listed above.
