Fidelis Care

The covered entity (CE), Fidelis Care, mailed diabetes and kidney health letters to the wrong members. The letters contained the names, addresses, and identification numbers of 638 individuals. The CE provided breach notification to HHS and affected individuals and offered credit monitoring. Upon discovering the breach, the CE performed a risk assessment, As a result of OCR’s investigation, the CE revised its safeguards policy regarding the printing of documents containing protected health information (PHI) and implemented a quality review process to assist with the inspection of outgoing mail that contains PHI. Additionally, the CE sanctioned and retrained the employees involved in the breach. OCR obtained assurances that the CE implemented the corrective actions listed above.
